Agreement to these terms

By downloading, installing, or using the mobile applications published by this company, you agree to these Terms of Use. If you do not agree, do not download or use the app. These terms are not a software development agreement.

Apps distributed through the Apple App Store are also subject to the Apple Media Services Terms and the App Store Policies. Apps distributed through Google Play are also subject to the Google Play Terms of Service. Those terms apply to you in addition to these.

License to use the app

We grant you a limited, non-exclusive, non-transferable license to use the app on a device you own or control, for your personal or internal business use. Any other use requires our written permission.

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app;
• Copy, modify, distribute, or create derivative works from the app;
• Use the app for unlawful purposes or to interfere with its operation;
• Resell, rent, or sublicense the app.

Accounts, subscriptions, and purchases

Some apps may offer accounts, subscriptions, or in-app purchases. Subscriptions and purchases are processed by Apple or Google through their stores, and renewal, cancellation, and refunds follow their terms. If an app offers an account, you are responsible for keeping your login credentials secure and for activity under your account.

Information you provide

Content you submit through the app — such as support messages — is used solely to respond to you and improve the app, as described in our App Privacy Policy.

Intellectual property

The app, including its code, design, trademarks, and content, is owned by Berry Simple Works LLC or its licensors and is protected by applicable laws. Except for the license granted in these terms, no rights are transferred to you.

Disclaimers

The apps are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Berry Simple Works LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the app.

Termination

We may discontinue, update, or remove an app at any time, and may terminate your access to an app where you materially breach these terms.
